Action in the Blue Earth County District Court brought by the owner of certain real estate for a declaratory judgment construing an agreement whereby one Walter M. Shirley, former owner of the premises, had leased them to defendant, Dalton Motors, Inc. Said defendant obtained leave to file a third-party complaint against said Walter Shirley, his wife, plaintiffs wife, and Hartzell Coal Company, which company had succeeded Walter Shirley as owner and had conveyed the premises involved to plaintiff. Defendant and third-party plaintiff appealed from a summary judgment, Milton D. Mason, Judge, entered against it.
